Death Sentence For Killing Burglar
Do you know that you can get a death sentence by killing a burglar!
What are we supposed to do when someone breaks into our home?
How shall we react when involved in home burglar for our own personal safety and security of our family?
A High Court in Shah Alam on Thursday, has sentenced two Indonesian brothers (who fought to defend themselves against an intruder in their own home) to death for the murder of a 26-year-old man who had broken into a shophouse in Sepang on 3rd December 2010.
It was clearly stated that the burglar had gained illegal entry into a building and was motivated by a criminal intent. It’s normal for everyone to act spontaneously to restrain an intruder who may pose a huge danger to us!
What a shock moves by our judges!
Is that mean we have no right to self defence in a life-threatening situations?
Are we more sympathy for the culprit than the victims?
Yes, I do agreed that no one should not take the law into their own hands. However when you involved this critical life-threatening situations, everything also can happen in the name of self defence.
Gallows for killing burglar
SHAH ALAM: Two Indonesian brothers were sent to the gallows by the High Court here after they were found guilty of murdering a burglar two years ago.
Frans Hiu, 22, and Dharry Frully Hiu, 20, were jointly charged with having a common intention in the murder of 26-year-old R. Khartic at a shophouse in 3A Jalan 4, Taman Sri Sungai Pelek in Sepang at 11am on Dec 3, 2010.
According to testimony presented during the trial, a witness saw Khartic breaking into the shophouse from the back entrance after he failed to break open the front door.
Khartic then entered the unit through the ceiling and fell into a room where the brothers and a Malaysian co-worker were sleeping.
The burglar then attacked the men and the Malaysian co-worker fled the scene during the struggle to contact the police.
Frans eventually managed to overpower Khartic by gripping him in an arm-lock from behind until he stopped moving. After realising that Khartic had become still, the brothers ran out of the unit.
The medical report confirmed that Khartic died due to blunt force trauma.
In her brief judgment, Justice Nurchaya Arshad ruled that the prosecution had successfully proven the case beyond reasonable doubt and sentenced the men to death.
A total of 15 prosecution witnesses took the stand.
The brothers were the only ones who testified in their own defence.

The two brothers should have just apprehend the intruder instead of killing him. i have no symphathy for the intruder and if i was in the same boat, i would have bash his head but not to the extend of taking someone else life. The intruder has committed a crime, that is, breaking and entering, with intention to steal. As for the brothers, it should have been homicide 2nd degree not amounting to murder. i feel life sentence or 20 years with parole is suffice. Death sentence? Mmmm…
